Terms and Conditions

These Terms and Conditions apply to your use of the Grow and Eat It app and website. Grow and Eat It is operated by Vanessa Mettam, sole proprietor trading under the ASIC registered business name Grow and Eat It.

1. Acceptance of terms
By creating an account, using the app or subscribing to paid features, you agree to these Terms and Conditions and our Privacy Policy.
If you do not agree, you must not use Grow and Eat It.
2. About the app
Grow and Eat It provides gardening information, sowing charts, plant records and tailored gardening tasks based on information such as your climate zone, location, plants and completed tasks.
The app is currently tailored for Australian gardeners. Information may be less accurate or unsuitable for users outside Australia.
3. Eligibility
Grow and Eat It is intended for adults. You must be at least 18 years old to create an account or purchase a subscription.
4. Accounts
You are responsible for:
Providing accurate account information.
Keeping your login details secure.
All activity that occurs under your account.
Updating your details if they change.
You must not share your account in a way that avoids subscription limits or misuses the app.
5. Gardening information disclaimer
Grow and Eat It provides general gardening information only. Gardening outcomes depend on many factors, including weather, soil, pests, diseases, water, seeds, seedlings, gardening methods and local conditions.
We do not guarantee that plants will grow successfully, that tasks will be suitable for every garden, or that weather or climate information will always be accurate or available.
You are responsible for deciding whether information in the app is suitable for your garden and circumstances.
6. Free tier and subscriptions
Grow and Eat It may offer a free tier with limited features or usage. Once you exceed the free tier benefits, access to some features may require a paid subscription.
Subscription pricing, billing frequency and included features will be shown before purchase.
Subscriptions purchased through the Apple App Store are managed by Apple. Subscriptions purchased through Google Play are managed by Google. Your subscription will renew automatically unless cancelled according to the relevant app-store rules.
7. Cancellations and refunds
You can cancel your subscription through your Apple App Store or Google Play account settings.
Cancellation stops future renewals but does not automatically refund amounts already paid. Refunds are handled by Apple or Google according to their policies and applicable law.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other applicable consumer protection laws.
8. Push notifications and communications
Grow and Eat It may send task reminders, gardening notifications, service messages and app updates.
You can manage push notifications through the app or your device settings. You can opt out of marketing emails using the unsubscribe link or by contacting us.
9. Acceptable use
You must not:
Use the app for unlawful, harmful or fraudulent purposes.
Attempt to access another person’s account.
Interfere with the security, operation or availability of the app.
Copy, scrape, reverse engineer or misuse app content or systems except as permitted by law.
Use the app in a way that could damage Grow and Eat It or its users.
10. Intellectual property
Grow and Eat It, including its app design, text, sowing charts, task content, branding, software and other materials, is owned by or licensed to Grow and Eat It.
You may use the app for your personal gardening use. You must not copy, reproduce, sell, publish or commercially exploit app content without written permission.
11. User gardening records
You retain ownership of the gardening records you enter into your account, such as plants you are growing and completed tasks.
You grant us permission to use that information as needed to provide, improve, secure and support the app.
12. Availability and changes
We may update, change, suspend or discontinue parts of the app from time to time. We may also change free tier limits, subscription features or app functionality.
We will try to avoid unnecessary disruption but do not guarantee that the app will always be available or error-free.
13. Account deletion and termination
You can delete your account through the app settings menu. After requesting deletion, you have 14 days to change your mind before the account is permanently deleted.
We may suspend or terminate your access if you breach these Terms, misuse the app, create security risks, or if we are required to do so by law.
14. Liability
To the maximum extent permitted by law, Grow and Eat It is not liable for indirect, incidental, special or consequential loss, including failed crops, lost produce, loss of profits, loss of data, or losses caused by reliance on gardening, climate or weather information.
Where liability cannot be excluded, our liability is limited to the remedies required under applicable law.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
16. Third-party services
The app relies on third-party services, including Firebase, Google Analytics, Google Cloud Run functions, OpenWeather API, Apple and Google. We are not responsible for third-party outages, errors, data practices or terms, except where required by law.
17. Privacy
Your use of Grow and Eat It is also governed by our Privacy Policy.
18. Changes to these Terms
We may update these Terms from time to time. If changes are material, we may notify you in the app, by email or through our website.
Continued use of the app after updated Terms are published means you accept the updated Terms.
19. Governing law
These Terms are governed by the laws of Western Australia, Australia. If another Australian state or territory is more accurate for your business, replace this clause with that jurisdiction.
